Drug Firms Must Face Pay-for-Delay Case

A Rhode Island judge has ordered three pharmaceutical corporations to face a Multi-District Litigation (MDL) case over accusations that they conspired to keep a generic version of the birth control medication Loestrin off the market.
The companies involved in the case are Warner Chilcott, Watson Pharmaceuticals, and Lupin Pharmaceuticals. Drug purchasers including pharmacy chains such as CVS and Walgreens, as well as “indirect purchasers” of drugs such as employee welfare benefit programs have accused the companies of conspiring to delay the entry into the market of lower-cost, generic alternatives to Warner Chilcott’s Loestrin.
Warner Chilcott could face antitrust and/or fraud charges if and when the case goes to trial.
