70 Hernia Mesh Cases Consolidated in Federal CourtJune 7, 2017
Seventy individual hernia-mesh lawsuits have been consolidated into a single Multi-District Litigation (MDL) case in Georgia’s Northern District. The cases originated in 36 different federal district courts, and will now be overseen by Judge Richard W. Story.
All of the cases concern product liability claims about the Physiomesh hernia mesh product manufactured by Ethicon. The suits allege that Physiomesh can lead to severe health complications in patients into whom it has been surgically implanted. The polypropylene plastic from which the mesh is constructed can decay within the human body, causing infection and other complications.
The defendants had opposed the consolidation of the many cases into a single MDL, but the U.S. Judicial Panel on Multidistrict Litigation denied that opposition.
Ethicon had promoted Physiomesh’s five-layer design as uniquely effective. However, this particular hernia mesh product has been named as the source of serious medical problems in a growing number of lawsuits. In many of these suits, the mesh has been found to have decayed, ruptured, or otherwise failed to perform its intended function of keeping in place internal tissues and organs.
