Staggering number of Lawsuits Against Johnson and Johnson

Johnson & Johnson Pending Lawsuits

December 5, 2017
One of the companies that the attorneys at TheLawFirm.com see repeatedly in our practice is Johnson & Johnson. The company recently filed this statement with the Securities and Exchange Commission:

“Johnson & Johnson and certain of its subsidiaries are involved in numerous product liability claims and lawsuits involving multiple products. Plaintiffs in these cases seek substantial compensatory and punitive damages. While the Company believes it has substantial defenses, it is not feasible to predict the ultimate outcome of litigation. To date in 2017, Johnson & Johnson has been exposed to over $1.5 billion in verdict awards related to various legal matters filed against products manufactured by the company.”

TheLawFirm.com sees cases against Johnson & Johnson for medical devices such as the DePuy ASR™ XL Acetabular System and DePuy ASR™ Hip Resurfacing System; the Pinnacle® Acetabular Cup Hip Implant System; Ethicon TVM and other pelvic mesh products as well as the physiomesh hernia mesh products.

Litigation against pharmaceutical products include lawsuits about Risperdal®, Xarelto® and Invokana®. Finally, they are being sued over personal care products such as baby powder that contains talcum powder.

The number of lawsuits against Johnson & Johnson are staggering. As of October 1, 2017 there were over 2000 claims involving the DePuy ASR™ XL Acetabular System and DePuy ASR™ Hip Resurfacing System. There are over 9000 claims involving the Pinnacle ® Acetabular Cup Hip System (a metal on metal hip). Over 54,000 claims remain outstanding due to Transvaginal Mesh and Pelvic Mesh. Many claims are in the works for the Physiomesh hernia mesh product. Over 13,000 claims are due to the drug Risperdal. Over 21,000 claims remain over Xarelto, the blood thinning drug. Over 5,000 claims are due to talcum powder. Finally, over 1000 claims are due to the diabetes drug Invokana.

The question that must be asked is this: is Johnson & Johnson sued so often simply because they are such a huge corporation or is it because they repeatedly produce defective medical devices or bad drugs? Juries have spoken throughout the United States on many of these products. For example, a jury in Texas recently awarded over $240 million dollars for a Pinnacle metal on metal hip lawsuit. We expect juries to continue to be critical of Johnson & Johnson products.
