Johnson & Johnson Challenges Damage Award in Pelvic Mesh Case

Ethicon, a subsidiary of Johnson & Johnson, has issued an appeal of a Pennsylvania judge’s order that revives a woman’s attempt to receive damages for injuries that she alleges she suffered from the surgical implantation of a pelvic mesh device. A jury recently cleared Ethicon of liability.
Ethicon filed its motion on the grounds that the judge in the trial admitted that the jury had been inconsistent in determining the cause of injuries in the case.
The pelvic mesh in question is a TVT Secur model, which had implanted in a woman named Kimberly Adkins in 2010 to treat her urinary stress incontinence. Adkins alleged that the mesh had been defectively designed, and the jury agreed, but did not support her claims that Adkins had suffered injuries as a result of the device.
Adkins required surgery in 2012 to remove the mesh, which at that point had deteriorated inside her body.
The victory for Ethicon in the original trial came at a moment when the company had lost four other mesh cases, in which it was ordered to pay some $50 million in damages.
