Pennsylvania Judge Will Study Viability of Pelvic Mesh Cases

In light of a recent decision by the U.S. Supreme Court, a Pennsylvania judge has said that he will study the 91 pelvic mesh lawsuit cases currently pending in the Philadelphia County Court of Common Pleas to determine whether they can proceed under the guidelines of the Philadelphia pelvic mesh mass tort program.

At issue is whether state courts have jurisdiction in cases filed by non-residents of those states. In issuing its recent Bristol-Myers Squibb decision, the U.S. Supreme Court ruled that out-of-state plaintiffs have limited rights.

Judge Arnold New in Philadelphia has remarked that his review of the 91 cases will be conducted in light of this decision.

Ethicon, the maker of the pelvic mesh devices in question, has stated that, since it is based in New Jersey, any claims against it may not be filed in Pennsylvania.

Ethicon has lost four pelvic mesh trials in Philadelphia, to the tune of nearly $50 million in damages.

Pelvic mesh devices such as those manufactured by Ethicon have been implicated in a wide variety of health problems, including pain, suffering, infection, and the necessity of revision surgery.
