Lipitor, Effexor Antitrust Suit against Pfizer Renewed

The Third Circuit Court has revived a fraud and antitrust suit against Pfizer and generic-drug maker Ranbaxy over the cholesterol-control drugs Lipitor and Effexor.
The court ruled that plaintiffs’ claims in the Multi-District Litigation (MDL) case are plausible. Plaintiffs allege that the defendants have artificially inflated the costs of the drugs. Specifically, Pfizer is accused of fraudulently procuring and enforcing a Lipitor patent and of an illegal reverse payment to Ranbaxy to keep a generic off the market; Pfizer subsidiary Wyeth is accused of patent fraud for Effexor XR and of an illegal reverse payment to Teva.
Multiple billions of dollars of drug sales are now under question, and the decision is seen as a major blow to the drugmakers, as the claims had previously been dismissed entirely.
The case is an enormously complex one, involving reversals of previous decisions and a host of drug companies. Centrally, though, the companies could stand to lose billions – not to mention credibility.
