In its most recent SEC financial disclosures filed August 2 for the period ending July 1, 2018, Johnson & Johnson, as a publicly traded company, was compelled to disclose the full extent of its potential liability from over 100,000 ongoing lawsuits filed against the company and its affiliates over products ranging from hip implants to pelvic mesh to pharmaceuticals to talcum powder.

TheLawFirm.com has conducted a review of Johnson & Johnson’s SEC Form 10-Q, which the company filed August 2, 2018, for clues as to the status of some of the ongoing legal battles that matter the most to our readers.

How could one company face so many product liability lawsuits simultaneously? Let’s take a closer look, based on J&J’s own legally required admissions.

Lawsuits Involving Johnson & Johnson and DePuy’s ASR XL Acetabular System and ASR Hip Resurfacing System

Following an August 2010 recall of the DePuy ASR XL Acetabular System and DePuy ASR Hip Resurfacing System, Johnson & Johnson reports that it and DePuy Orthopaedics, Inc. continue to face thousands of lawsuits in countries around the globe over alleged defects to these hip-replacement products. While lawsuits in the United States have been consolidated into multidistrict litigation (MDL) taking place in the Northern District of Ohio, J&J and DePuy also report facing lawsuits in the United Kingdom, Canada, Australia, Ireland, Germany, and Italy.

The companies already have agreed to a series of settlements in the United States, which Johnson & Johnson states has resolved over 10,000 individual claims to date. Meanwhile, the company has entered into a class-action settlement in Australia that it says will resolve “the majority of ASR hip complaints in that country,” along with two class-action settlements in Canada. However, J&J warns investors that, despite these figures, thousands of additional lawsuits relating to DePuy ASR hip products remain pending in the US and around the world.

Lawsuits Involving Johnson & Johnson and DePuy’s PINNACLE Acetabular Cup System

According to Johnson & Johnson’s most recent Form 10-Q filed August 2, 2018, the company and its subsidiary DePuy Orthopaedics, Inc. also continue to face ongoing litigation over their Depuy PINNACLE Acetabular Cup System, another failed product designed and manufactured by the companies that was intended to be used in hip replacement surgery.

“The number of pending product liability lawsuits continues to increase,” J&J reported regarding the PINNACLE Acetabular Cup System, with cases in the US having been consolidated in multidistrict litigation (MDL) being conducted in the Northern District of Texas. The company also faces litigation over the hip-replacement product in the United Kingdom, according to its filing. As of July 1, 2018, J&J reported 10,300 pending lawsuits associated with the PINNACLE Acetabular Cup System.

Lawsuits Involving Johnson & Johnson and Ethicon’s Pelvic Meshes

Johnson & Johnson reports that as of July 1, 2018, it and its subsidiary Ethicon, Inc. continue to face tens of thousands of lawsuits over alleged defects to Ethicon’s pelvic mesh devices. Intended to be used in the treatment of urinary incontinence and pelvic organ prolapse, surgical mesh has been implicated in the development of a host of dangerous side effects.

In addition to multidistrict litigation (MDL) taking place in the Southern District of West Virginia, J&J and Ethicon face significant legal exposure outside the United States, as well. J&J expects resolution of a class-action lawsuit in Australia sometime in 2018, and it faces other class-action suits in Israel and Canada. Additionally, individual product liability lawsuits over Ethicon pelvic meshes have been brought in the United Kingdom, the Netherlands, and Belgium, J&J reports.

In total, J&J says it faces over 50,000 pending lawsuits over Ethicon pelvic mesh products.

Lawsuits Involving Johnson & Johnson and Janssen’s RISPERDAL

Designed to treat schizophrenia, acute manic or mixed episodes associated with bipolar I disorder, and irritability associated with autism, the drug RISPERDAL continues to be the subject of thousands of pending lawsuits over its alleged side effects, according to a financial disclosure submitted to the SEC by Johnson & Johnson.

As of July 1, 2018, Johnson & Johnson and its subsidiary Janssen Pharmaceuticals, Inc. reported to have been facing 13,500 pending RISPERDAL lawsuits, many of which were state-court claims, predominantly in Pennsylvania, California, and Missouri, though “[o]ther actions are pending in various courts in the United States and Canada” and “[p]roduct liability lawsuits continue to be filed.”

Lawsuits Involving Johnson & Johnson and Janssen’s XARELTO

As of July 1, 2018, Johnson & Johnson and its subsidiary Janssen Pharmaceuticals, Inc. remain defendants in over 20,000 lawsuits filed over alleged defects to the companies’ oral anticoagulant XARELTO, according to financial disclosures filed with the Securities and Exchange Commission (SEC) on August 2. Bayer AG, which, along with some of its affiliates, served as a “collaboration partner” on XARELTO, also has been involved in the litigation.

Federal XARELTO cases in the US have been consolidated as multidistrict litigation (MDL) in the Eastern District of Louisiana, though the companies also face coordinated state-court proceedings in Pennsylvania, California, and Missouri, in addition to a mass tort action taking place in Philadelphia. According to J&J’s filing, “Class action lawsuits also have been filed in Canada.”

In total, Johnson & Johnson reports that it faced 24,500 pending XARELTO lawsuits as of July 1, 2018.

Lawsuits Involving Johnson & Johnson Talcum-Powder Products

As regular readers of TheLawFirm.com know, Johnson & Johnson has been hit with several nine- and ten-figure verdicts recently over allegations that its talcum-powder products caused ovarian cancer and mesothelioma in consumers.

Despite staggering sums involved in recent verdicts against Johnson & Johnson over its talcum-powder products, J&J reported that it “believes it has strong grounds on appeal to overturn these verdicts.”

Lawsuits Involving Johnson & Johnson and Janssen’s INVOKANA

As of July 1, 2018, Johnson & Johnson and its subsidiary Janssen Pharmaceuticals, Inc. continued to face over 1,000 ongoing lawsuits over alleged side effects of the companies’ diabetes drug INVOKANA, J&J reported in SEC documents filed August 2.
