Acid Reflux Multidistrict Litigation Case to Be Held in New Jersey
August 7, 2017
The Judicial Panel on Multi-District Litigation (JPMDL), a council of the U.S. Supreme Court, has combined 161 lawsuits concerning gastric acid reduction drugs and sent them to be tried in an MDL case in New Jersey federal court.
The cases involve a number of over-the-counter acid reflux drugs, including Nexium, Prevacid, and Prilosec. At issue in the cases is whether the drugs cause kidney injuries. Defendants in the MDL case are drug giants AstraZeneca, Pfizer, Procter & Gamble, and Takeda Pharmaceuticals.
An earlier attempt to consolidate the cases had failed.
New Jersey was chosen as the site of the trial because at least 60 of the cases had been filed in that state’s courts.
Since 2011, the U.S. Food and Drug Administration has heard complaints about the allegedly harmful renal side effects of these medications. The agency required warning labels to be added to the drugs in 2014. In 2016, a study found that the drugs could increase the risk of chronic kidney disease by 20 to 50 percent.
